    This privacy policy ("Privacy Policy" or “Policy”) describes how Bitwixt Software Systems LLC (“Bitwixt”, “we”, or “us”) collects, protects, uses and shares Personal Information gathered from Users of its Atomsmith® Classroom Online Educational Service ("Service"). It is important to us that Customers who have purchased and are using our Service (“Customer(s)”, or “you”) understand the measures that we have taken to provide, through our Service, a safe and trustworthy environment for all Users.

    Although later sections of this Privacy Policy provide detailed information on our collection, use and disclosure of Personal Information, we want to highlight the following:

    Changes to this Policy

    We encourage you to read through and understand this Privacy Policy. From time to time, we may update the Policy to reflect changes to our Service. If we are making updates that involve material changes to the collection, protection, use or disclosure of Personal Information, we will attempt to provide you with notice of the revisions. This notice may occur through methods that may include, but are not limited to, e-mail, postal mail, or website notices.

    Customers should ensure that they keep students, parents, and other stakeholders informed of any material changes. Please feel free to contact us if you have questions or concerns regarding intended Privacy Policy revisions.

    We reserve the right to revise the terms of this Privacy Policy. Any such revisions to this Policy are effective immediately upon posting of a revised Policy. Your use of the Service subsequent to such posting constitutes your acceptance of such revisions.

  4. Personal Information That We Collect

    We collect two forms of information about Users of the Service:

    1. Personal Information input by a Customer/User for entry into the Service
    2. Usage Data

    We may also collect Personal Information through other methods that follow the terms of this Privacy Policy.

    Student Data Input by Customers

    Required Student Data

    • Email Address
      (used as User's username for authentication)
    • School/Institution/District Name

    Optional Student Data

    • None

    Disposal of Student Data

    Once yearly (at the beginning of August), all school accounts are reset (cleared). This means that all email addresses associated with student accounts at each school are deleted and not retained.

    If a school requests that a student's account be deleted, we will do so within 2 business days.

    Educator Data Input by Customers

    Required Educator Data

    • First and Last Name
    • Email Address
      (used as User's username for authentication)
    • School/Institution/District Name

    Usage Data

    Application and system logs are critical to ensuring the availability and security of the Service. We collect log data for such purposes as monitoring the health of the Service, detecting unauthorized access and fraudulent activity on the Service, preventing and responding to Service-related security incidents, ensuring appropriate scaling of the Service’s computing resources, and reporting usage.

    Data Generated By Users During use of the Service

    No User-generated data is collected during use of the Service.

    Guided exercises and associated questions that may be used for assessment are provided in the form of read-only pdf files. All responses to questions asked of a User are recorded externally from the Service (e.g., on printed pdf files or in lab notebooks).

    Third-Party Collection

    We do not permit third-party ad networks or similar services to collect the Personal Information of our Users.

  5. How We Use Personal Information

    We use Personal Information for User authentication, to improve the Service, and to exercise our legal rights, as described below.

    Education

    We use Personal Information to provide Customers and Users with the educational Service requested. We may use Personal Information for any purposes required or permitted under our Terms of Service or with your consent.

    Legal and Safety Uses

    We may use Personal Information to protect or exercise our legal rights, to defend against claims, to investigate fraud and other criminal conduct, to enforce our Terms of Service, to respond to a government request, to protect the security, integrity and availability of the Service, or to otherwise protect the property and safety of Bitwixt, our Users, and others.

    De-Identified and Aggregate Data

    We may use Usage Data and other properly de-identified or aggregate data to improve the Service and its existing products, to develop new products, to communicate product effectiveness and outcomes, and for other related purposes. Unless required to do so by law, we will not attempt to re-identify de-identified data and, where feasible and appropriate, will not transfer de-identified data to a third party unless they also agree not to attempt re-identification.

  6. How We Share Personal Information

    We may share Personal Information with third parties as described below.

    Subcontractors

    We may hire subcontractors, vendors or other third parties to help deliver or improve the Service. Third-parties that we work with who have access to Personal Information are subject to stringent privacy and security contractual requirements including, but not limited to, prohibitions on collection, use or disclosure of Personal Information, and maintenance of a comprehensive information security program.

    Merger, Acquisition or Bankruptcy

    If we are involved in a merger, acquisition, or sale of all or a portion of our assets, we may need to share Personal Information with the acquiring entity. We will condition any merger, acquisition, or sale on continued adherence to the terms of this Policy and to maintaining a materially similar level of protection for Personal Information. If such an event occurs, we will provide you information about the coming change.

    Legal and Safety Disclosures

    We may disclose Personal Information when it is required or permitted by law, such as to comply with a subpoena, court order or similar legal process, to protect or exercise our legal rights, to defend against claims, to investigate fraud and other criminal conduct, to enforce our Terms of Service, to respond to a government request, to protect the security, integrity and availability of the Service, or to otherwise protect the property and safety of Bitwixt, our Users, and others.

  7. Security

    We store and process Personal Information in accordance with industry standards and applicable law. Our comprehensive information security program protects Personal Information from unauthorized access, use and disclosure through the use of reasonable and appropriate physical, administrative and technical safeguards. We perform periodic risk assessments of our information security program and prioritize remediation of identified security vulnerabilities. Nevertheless, security is a shared responsibility and no method of data transmission over the Internet or method of electronic storage is 100% secure. Therefore, we cannot guarantee the absolute security of Personal Information.

    The Service is hosted on computer servers managed by Amazon Web Services (AWS). For more information about AWS security practices, click here.

    If you have general questions for us regarding the security and confidentiality of Personal Information, please feel free to contact us using the information in Section C above.

    Breach Notification

    In the event of a security incident affecting our systems that involves Personal Information, we will notify you as required by applicable law and the terms of this Policy. We will always attempt to notify you of any security incident affecting Personal Information that we believe poses a material risk of harm to Customers or Users.

  8. Customer Responsibilities

    Although we have taken numerous steps to ensure the privacy and security of Personal Information, your use of the Service must also be in accordance with prevailing security practices. These practices include, but are not necessarily limited to, (i) not sharing your authentication information, (ii) avoiding the upload of unnecessary Personal Information into the Service, (iii) exercising oversight to ensure Customer's Educator and Student Users are using the Service appropriately, (iv) training and educating Users on the importance of privacy and security, and (v) limiting information sharing by allowing Users to access only the information that they need.

    External Content

    The Service links to pages on other websites for the convenience of Users. Bitwixt is not responsible for the availability of content on these webpages, nor does it endorse or warrant the services, products or information offered on these other pages, unless explicitly stated. If you have reason to believe that content on these external websites is inappropriate or infringes on the intellectual property rights of others, please contact us as indicated in Section C, above, and we will investigate and take appropriate action.
